Welcome to Fluent Friends! These Terms of Service ("Terms") govern your use of our English language learning application ("App") provided by Fluent Friends ("Company", "we", "our", or "us"). By accessing or using our App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our App.

1. Use of the App

1.1. Eligibility: You must be at least 13 years old to use our App. By using the App, you represent and warrant that you have the right, authority, and capacity to enter into these Terms.

1.2. Account Registration: To access certain features of the App, including the subscription services, you may need to create an account. You agree to provide accurate and complete information when creating your account and to keep your account information up to date.

1.3. Subscription Services: Our App offers both free and premium subscription services. Premium subscriptions provide access to additional features and content. By subscribing to our premium services, you agree to pay the applicable subscription fees and to comply with any additional terms and conditions related to the premium services.

2. Subscription and Payment

2.1. Subscription Plans: We offer various subscription plans for premium access, which may include monthly or yearly options. Details of the subscription plans and pricing are available within the App.

2.2. Payment: Subscription fees are billed in advance on a recurring basis and are non-refundable. You authorize us to charge your chosen payment method for the subscription fees. If we cannot charge your payment method, we may suspend or terminate your access to the premium services.

2.3. Cancellation: You may cancel your subscription at any time through the App's account settings. Your cancellation will take effect at the end of the current billing cycle. No refunds will be provided for the remaining period of your subscription.

3. User Conduct

3.1. Prohibited Activities: You agree not to use the App for any unlawful purpose or in any way that could harm, disable, overburden, or impair the App. Prohibited activities include, but are not limited to:

  • Harassing, threatening, or defaming other users.

  • Attempting to gain unauthorized access to any part of the App.

  • Using the App to transmit any viruses or malicious code.

  • Engaging in any activity that violates any applicable law or regulation.

3.2. Content: You are responsible for any content you submit or transmit through the App. You agree not to submit any content that is unlawful, offensive, or infringes on the rights of others.

4. Intellectual Property

4.1. Ownership: The App and its content, including but not limited to text, graphics, logos, and software, are the property of Fluent Friends and are protected by intellectual property laws. You may not use, reproduce, or distribute any part of the App without our prior written permission.

4.2. License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for your personal, non-commercial use.

5. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the App is at your own risk.

6. Limitation of Liability

To the fullest extent permitted by law, Fluent Friends shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the App.

  • Any unauthorized access to or use of our servers and/or any personal information stored therein.

  • Any interruption or cessation of transmission to or from the App.

  • Any bugs, viruses, or similar issues transmitted through the App by any third party.

7. Changes to the Terms

We may modify these Terms at any time. If we make material changes to these Terms, we will notify you by email or through the App. Your continued use of the App after the changes become effective constitutes your acceptance of the new Terms.

8. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.
